Can you give spirits as a gift to someone under eighteen?

What exactly does Article 20 of the Alcohol Act prohibit?

Article 20(1) prohibits supplying alcohol in the course of business, or otherwise than free of charge, to anyone whose age of 18 has not been established.

Supplying is broader than selling. It concerns every transfer involving a business or a consideration, so also a free tasting glass in a shop. Paragraph 2 says how age is established: with a document under the Identification Obligation Act, unless someone is unmistakably older. In the wine & spirits shop in Bathmen we therefore ask for proof of identity, even when the bottle is meant as a gift.

Is a gift the same as selling?

A shop may never give a bottle to a minor, paid or free.

What may a minor not do themselves?

Anyone under 18 may not carry alcoholic drinks in places open to the public.

That rule is in article 45 of the Alcohol Act, in the section with provisions of a criminal nature. A violation is therefore a criminal offence for which a fine may follow. A place accessible to the public is to be interpreted broadly: the street, a park, a station, a shopping centre, a hospitality venue. An unopened bottle counts just as much as an opened one. A gift that goes home by bike thus becomes a problem after all.

May you buy a bottle for someone under 18?

No, buying drinks to pass on to a minor is exactly what the law is aimed at.

Article 20 also treats supplying to an adult as an offence when the drink is evidently intended for someone who has not been established to be 18. If you are at the till with a young person who is visibly ordering along with you, the sale does not go ahead. For you as a buyer the sum is simple: you put that young person in trouble the moment they walk down the street with the bottle.

What do you give instead of a bottle of spirits?

Give something without alcohol, or give a voucher that can only be redeemed from the age of 18.

Alcohol-free versions of beer, wine and spirits are simply on the shelf in Bathmen, and there is plenty among them to give as a gift. A gift voucher also works: the voucher is the gift, and when it is redeemed the age is checked as article 20 paragraph 2 prescribes. If you still want to set a bottle aside for later, keep it at home until the birthday arrives. Feel free to drop in; we are happy to help you decide.
